Terms of Service

1. Acceptance of Terms

By accessing or using GoFile ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including users without an account ("guests") and registered users.

GoFile is operated by GoFile Technologies SAS, a company registered in France. By using the Service, you represent that you are at least 13 years old (or the applicable age of digital consent in your jurisdiction).

2. Account Registration

You may use GoFile without creating an account for basic uploads. To access premium features, folder management, and longer file retention, you must register an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party
• Not create multiple accounts to circumvent limits or bans

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use GoFile to upload, store, or distribute any content that:

• Is illegal under applicable law, including child sexual abuse material (CSAM)
• Constitutes malware, ransomware, spyware, or any malicious code
• Infringes the intellectual property rights of any third party
• Constitutes spam, phishing, or unsolicited commercial communications
• Violates the privacy or personal data rights of others
• Facilitates illegal activities, including fraud, hacking, or drug trafficking

You also agree not to: scrape, crawl, or index the Service; attempt to gain unauthorized access to any part of the Service; interfere with the Service's infrastructure; or use automated tools to upload files in bulk without prior written authorization.

4. Your Content

You retain full ownership of all files you upload to GoFile ("Your Content"). By uploading content, you grant GoFile a limited, non-exclusive, royalty-free license to store, reproduce, and transmit Your Content solely to provide the Service.

We do not sell, rent, or share Your Content with third parties except as required by law or as necessary to operate the Service (e.g., content delivery networks). We do not analyze the content of your files for advertising purposes.

You are solely responsible for Your Content and the consequences of uploading and sharing it. GoFile acts as a passive conduit and does not monitor uploaded files prior to storage.

5. Storage & Retention

File retention depends on your account type:

• Guest uploads: Retained for 10 days with at least one download; deleted sooner if never downloaded
• Free accounts: Retained for 10 days of inactivity; active files are kept indefinitely
• Premium accounts: Retained indefinitely while your subscription is active

GoFile does not guarantee any specific storage duration. We reserve the right to delete content at any time if it violates these Terms or poses legal or operational risk. Deleted files cannot be recovered.

6. Premium Services

GoFile offers optional paid plans ("Premium"). By subscribing, you agree to pay the applicable fees. All fees are non-refundable except as required by applicable consumer law. Premium subscriptions auto-renew unless cancelled before the renewal date.

We reserve the right to change pricing with 30 days' notice. Continued use of Premium after a price change constitutes acceptance of the new pricing.

7. DMCA & Copyright

GoFile respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on GoFile infringes your copyright, please send a takedown notice to:

Your notice must include: (i) identification of the copyrighted work; (ii) identification of the infringing material with sufficient detail to locate it; (iii) your contact information; (iv) a statement of good faith belief; and (v) a statement of accuracy under penalty of perjury.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately and we may delete your files and account data.

You may delete your account at any time through your account settings. Deletion requests are processed within 30 days.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOFILE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOFILE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO GOFILE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Changes to Terms

We may modify these Terms at any time. We will notify registered users by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
